Terms of Service

These Terms of Service ("Terms") govern your use of launchpact.in and the placement services offered by LaunchPact ("LaunchPact", "we", "us", "our"). By submitting the application form or engaging our services, you ("you", "Candidate") agree to these Terms.

1. The service we provide

LaunchPact is a placement-assistance service for IT professionals seeking better-paying roles. Our scope of work includes:

• Reviewing applicant profiles for fit with our partner network
• Rebuilding and optimizing your resume and LinkedIn profile
• Coaching on interview preparation, mock sessions, and salary negotiation
• Conducting targeted IT recruiter outreach to introduce you to potential employers

We do not guarantee a job offer, a specific salary outcome, or placement within a specific timeframe. We do not act as a legal representative or employer. The decision to extend any job offer rests entirely with the hiring company.

2. Eligibility

To use our service you must:

• Be at least 18 years of age
• Be legally entitled to work in India (or in the jurisdiction of the role you are applying to)
• Provide accurate, complete, and current information about yourself
• Not be subject to any non-compete, non-solicitation, or other contractual restriction that would prevent you from changing employers

3. Fees and payment (The Milestone Model)

• Milestone 1 (Signup Fee): A non-refundable upfront fee of ₹2,999 is required at signup. This covers initial onboarding, your resume rewrite, profile optimization, and job search strategy session.
• Milestone 2 (Offer Letter Fee): A placement milestone fee of ₹5,000 to ₹8,000 (depending on your selected plan) becomes payable only when you successfully receive a job offer sourced through our program.
• Milestone 3 (Success Fee): A final success fee of 8% to 15% (depending on your selected plan) of your first month's salary is payable only after that salary is credited to your bank account.
• If you don't get placed: You are not liable for Milestone 2 or Milestone 3. You only fully pay when you win.
• If you leave the new role within [Z] months: The terms regarding any partial refunds or waivers of the final success fee will be outlined in your individual agreement.
• All amounts are in Indian Rupees and are exclusive of GST, which will be added at the rate prevailing at the time of invoicing.

4. Your obligations

• Provide truthful information at all times. Misrepresentation may terminate our engagement.
• Attend scheduled coaching sessions, mock interviews, and actual interviews you have committed to.
• Disclose any active offers, pending applications, or notice-period constraints that may affect placement.
• Not share interview content (questions, take-home assessments) with third parties.
• Notify us within 5 business days of receiving and/or accepting any offer sourced through LaunchPact.
• Not bypass LaunchPact to deal directly with an employer to whom we introduced you, for the duration of our engagement plus 12 months.

5. Our obligations

• Treat your personal data per our Privacy Policy and the DPDP Act, 2023.
• Only share your profile with employers after your explicit approval.
• Provide honest, real-time feedback on your candidacy and interview performance.
• Refund any wrongly-collected fee within 14 days of dispute resolution.

6. Intellectual property

All content on launchpact.in — including text, graphics, logos, code, and coaching materials — is owned by LaunchPact or its licensors. You may view and print pages for personal, non-commercial use only. You may not reproduce, redistribute, or create derivative works without written consent.

7. Disclaimers

Our service is provided "as is" and "as available". We make no warranty that:

• You will receive any specific job offer or salary outcome.
• Any specific employer will respond, interview you, or hire you.
• The site will be uninterrupted, error-free, or secure against every possible threat (we follow industry-standard security practices, but no system is invulnerable).

Any salary figures, placement statistics, or testimonials shown on the site are illustrative of past outcomes and not a guarantee of future results.

8. Limitation of liability

To the maximum extent permitted by Indian law, LaunchPact's total liability to you for any claim arising from these Terms or our service shall not exceed the total fees you have actually paid to us in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages — including loss of earnings, loss of opportunity, or reputational harm — even if we were advised of the possibility.

9. Termination

• You may withdraw from our service at any time before accepting an offer, by emailing admin@launchpact.in. No further milestone fees apply if you withdraw before receiving an offer, but the initial ₹2,999 signup fee is retained for services already rendered.
• We may terminate the engagement if you misrepresent information, breach these Terms, or behave abusively toward our team or partner employers. Termination does not waive any fee already triggered.

10. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall first be addressed via good-faith negotiation between you and our grievance officer (see Privacy Policy Section 12). If unresolved within 30 days, the dispute shall be referred to arbitration in [Chennai], Tamil Nadu, conducted by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The courts at [Chennai] shall have exclusive jurisdiction over any matter not subject to arbitration.

11. Changes to these Terms

We may update these Terms from time to time.Material changes affecting active candidates will be notified by email at least 14 days before they take effect.
